Terms & Conditions

1. Provider and scope

These Terms & Conditions apply to services of Italian’s Food AG / Ristorante Linde, Hauptstrasse 27, 5314 Kleindöttingen, offered or requested via the website or in connection with the restaurant, in particular table reservations, room enquiries, take-away services and shop orders. Individually confirmed written agreements take precedence.

2. Offers, menus and prices

Offers, menus, daily and weekly menus and product availability may change. The prices shown for the relevant service/order or expressly confirmed in Swiss francs (CHF) apply. Statutory public charges and non-optional surcharges are included in the stated final price. For measurable prepacked shop goods, a base price is additionally displayed where legally required.

3. Enquiries, orders and contract formation

Submitting a form, reservation request or shop order constitutes a request or offer by the guest/customer. An automatic acknowledgement only confirms receipt. A binding contract or final reservation arises only upon express confirmation by Ristorante Linde. Entries can be reviewed and corrected before submission.

4. Table reservations

A table reservation is final only after express confirmation. Confirmation relates to the date, time and number of registered guests. Material changes require renewed confirmation. A particular table or area is owed only if expressly confirmed.

5. Cancellation and no-show

Confirmed reservations may be cancelled free of charge up to 24 hours before the reserved time. If guests do not attend without timely cancellation, a no-show fee of CHF 50 per registered person may be charged. Different cancellation terms may be set in the confirmation for groups, banquets, special occasions or individually agreed services and take precedence.

6. Room enquiries and reservations

Room enquiries become binding only after availability has been checked and express confirmation issued. The confirmed room type, price, stay and special conditions apply. Unless the confirmation provides otherwise, the above 24-hour cancellation rule applies. Individually agreed deposits, payment deadlines or special terms take precedence.

7. Shop and ordering process

Only currently enabled products are offered. Customers add products to the cart, review quantities, prices, contact details and payment method, then submit the order. The automatic acknowledgement is not acceptance. The order becomes binding only upon express confirmation by Ristorante Linde. The shop currently provides pickup at the restaurant only; shipping is not offered.

8. Payment methods

The current shop payment methods are prepayment and pickup with cash payment at the restaurant. For prepayment, payment details and due date are provided with confirmation and goods may be withheld until payment is received. For cash payment the confirmed amount is due at pickup.

9. Pickup and availability

Pickup time and availability are specified in the confirmation. Products are promised only subject to actual stock. If a confirmed product or service cannot exceptionally be provided, the customer will be informed as soon as possible and payments for unperformed services will be refunded.

10. Alcohol and age verification

Alcoholic products are supplied only to persons who meet the legally required minimum age. Ristorante Linde may require official proof of age at pickup and refuse supply if age cannot be established.

11. Food, ingredients and allergies

For restaurant dishes, our staff will provide information on request about ingredients that may cause allergies or intolerances. Guests with allergies or intolerances should inform staff expressly before ordering. For prepacked shop products, the information on the product packaging is authoritative and should be checked before consumption.

12. Complaints and defects

Obvious defects or incorrect products should, where possible, be checked upon handover/pickup and reported without delay. Mandatory statutory rights in case of defects remain reserved. The nature and condition of food products may be taken into account when assessing complaints.

13. Returns and withdrawal

Swiss law provides no general statutory right of withdrawal for ordinary online purchases. Voluntary return or cancellation of an already confirmed shop order is therefore possible only by agreement with Ristorante Linde. Mandatory statutory claims, in particular for defective goods, remain reserved.

14. Service interruptions and force majeure

Events outside Ristorante Linde’s reasonable control, such as official orders, power/system outages, supply shortages or comparable events, may require confirmed services to be adjusted, postponed or cancelled where performance becomes impossible or unreasonable. Payments for services not performed will be refunded unless a replacement is agreed.

15. Liability

Ristorante Linde is liable in accordance with applicable law. To the extent permitted by law, liability for slight negligence is limited to typically foreseeable direct damage. Liability for unlawful intent or gross negligence is not excluded. Mandatory statutory liability remains reserved.

16. Privacy

Personal data is processed in accordance with the current Ristorante Linde privacy notice available on the website under “Imprint & Privacy”.

17. Changes and applicable version

The version of these Terms displayed and accepted when the request or order is submitted applies. Ristorante Linde may amend these Terms for future transactions. Changes affect already confirmed contracts only if agreed or legally mandatory.

18. Applicable law and jurisdiction

Swiss law applies. Mandatory consumer protection provisions and mandatory statutory places of jurisdiction remain reserved. Where a jurisdiction agreement is permitted, the registered office of Italian’s Food AG is the place of jurisdiction.
